1. About Erivia and our service
Erivia is not a travel agency or a booking service, but a travel design service based in Norway. We design trips across Europe, with Norway as our speciality.
We don't work from ready-made templates; every design is tailored to you. This means the travel design is, to some extent, perishable. Your dream trip is created by real people who are experienced and qualified, and our goal is to find your dream trip and save you time and stress.
Once the travel design is ready, you receive a bespoke itinerary with links to every place, so you can easily book the trip yourself. Erivia does not book, arrange or sell travel services such as accommodation, transport or activities, and does not accept payment for such services. Erivia is therefore not an organiser or retailer of package travel or linked travel arrangements under the Norwegian Package Travel Act (pakkereiseloven).
2. The parties
The seller is Osland Erivia (sole proprietorship), company reg. no. 938 345 732, Sandevegen 515, 5977 Ånneland, Norway, email post@erivia.no. In these terms, the seller is referred to as "Erivia", "we" or "us".
The buyer is the consumer who orders the service, referred to as "you" or "the customer".
3. The agreement
The agreement consists of these terms and conditions, the package description in our online shop, the information you provide in your order and travel brief, and anything else we agree with you in writing, for example by email. In the event of any conflict, what we have specifically agreed with you takes precedence, provided it does not conflict with mandatory law.
The agreement becomes binding on both parties once you have placed your order and received an order confirmation by email. However, it is not binding if there is an obvious typing or keying error in the offer or the order, and the other party understood or ought to have understood that it was an error.
The agreement is supplemented by relevant legislation, including the Norwegian Contracts Act, Cancellation Act, Marketing Control Act and E-Commerce Act. These terms do not limit any rights you have under mandatory law.
4. The packages and what's included
What each package includes – such as the number of travel days, the number of places or countries, and the size of your travel party – is set out in the package description in our online shop. Choose the package that best fits the trip you have in mind. If you're unsure, we're happy to help before you book.
Once you've received your travel design, you let us know if you'd like any changes. Usually up to three rounds of revisions are included. If you'd like changes that go beyond the package you've bought – such as extra travel days or a completely different destination – we'll agree this and any additional cost with you before making the changes.
Erivia Extraordinary is a consultation, not a travel package. In the consultation, we go through your wishes and make a plan together for the next steps and the price. Any further planning is agreed and paid for separately.
5. Price and payment
The price shown for each package is the total price you pay for the service, including all taxes and fees. You will not be charged any costs we have not told you about before your purchase.
The package price covers Erivia's travel design only. The trip itself – accommodation, transport, activities and meals – you book and pay for directly with the individual providers.
The payment is reserved when you order, but it isn't taken until you receive the travel design Erivia has created for you. For Erivia Extraordinary, the payment is taken once the consultation has taken place. You pay using the payment methods offered at checkout.
6. Delivery of the travel design
Once we have received your order and travel brief, we get to work. We prefer to keep in touch by email, but if you'd like or need to, we're happy to talk by phone or FaceTime. Ideas can strike at any moment, so staying in touch along the way is an important part of the process.
The travel design is delivered digitally to the email address you gave in your order. Delivery has taken place once the travel design has been sent to you. Unless otherwise agreed, we deliver within a reasonable time and no later than 30 days after receiving your order and the information we need to get started.
If we don't deliver on time, and this is not due to you, you may, depending on the circumstances, withhold payment, require us to deliver, cancel the agreement or claim compensation.
7. Booking your trip
Once Erivia sends you a finished travel design, it's up to you to book the trip. Any agreements you make with hotels, transport companies, activity providers and other suppliers are between you and them, and their terms, prices and cancellation policies apply.
Book as soon as you can
Everything is available when you receive the links, but we can't be held responsible for it still being available when you book. Prices and availability may also change. That's why it's wise to book as soon as possible after receiving your travel design.
Nor is Erivia responsible for the individual components of the trip, such as the suppliers' quality, changes, delays or cancellations. You are responsible for having a valid passport, visas, vaccinations, travel insurance and the like – though we're always happy to share tips and advice.
Your travel design is based on the information you give us, so please make sure it's accurate and complete – for example about your travel party, dates and any need for extra support.
8. Right of withdrawal
You have a 14-day right of withdrawal under the Norwegian Cancellation Act (angrerettloven), starting the day after the agreement is made. When you order, you ask us to start work straight away, within the withdrawal period. If you withdraw after we've started, you pay for the part of the work already carried out. The right of withdrawal ends once the travel design has been delivered, or once the consultation has taken place.
You'll find full information and a withdrawal form on our right of withdrawal page.
9. Defects and complaints
If the travel design does not match what was agreed – for example if content included in the package is missing – you must let us know within a reasonable time after you discovered, or ought to have discovered, the defect. Ideally, tell us in writing, for example by email to post@erivia.no.
We will put the defect right as quickly as possible. If it is not put right within a reasonable time, you may, depending on the circumstances, claim a price reduction, cancel the agreement or claim compensation.
A supplier no longer having availability, changing its prices or not delivering as expected is not considered a defect in the travel design – see section 7.
10. Erivia's liability
Erivia is responsible for carrying out the travel design with professional care and in line with the agreement. We are not responsible for services provided by others, or for losses caused by circumstances beyond our control.
To the extent permitted by mandatory law, Erivia's liability is limited to the amount you have paid for the service, and we are not liable for indirect losses. This limitation does not apply if we have acted with gross negligence or intent.
11. Use of the travel design
The travel design is created for you and your travel party, and is for personal use only. It may not be resold, published or used commercially without a written agreement with Erivia.
12. Personal data
Erivia is the data controller for the personal data you give us and uses it to deliver the service. Read more in our privacy policy.
13. Complaints and disputes
If you're not happy, please contact us at post@erivia.no. We always try to find an amicable solution.
If we can't reach an agreement, you can contact the Norwegian Consumer Council (Forbrukerrådet) for mediation at forbrukerradet.no or on +47 23 400 500. The agreement is governed by Norwegian law.
